This Terms of Service is made between CheckThisPlaceOut.com, an Allsopp Realty, Inc. subsidiary, and any person (collectively "you", "your" or "I") who uses any of the services offered on this website.

By accessing or using any part of the service, you expressly agree to and consent to be bound by all of the terms of this agreement. If you do not agree to all of the terms of this agreement, you may not access or use any part of the service.

Notice to Renters
CheckThisPlaceOut.com assumes no responsibility for the accuracy of advertisements on this web site, nor the condition of property, nor the character of the owner. It is the responsibility of the potential renter to investigate the property home owner and their property and strongly recommended to ascertain the validity of each property. Obtain terms and conditions in writing. Rates are subject to change without notice.

Notice to Home Owners and Managers
You represent and warrant to CheckThisPlaceOut.com that: (a) you are over the age of eighteen (18) and have the power and authority to enter into and perform your obligations under this Agreement; (b) you shall comply with all terms and conditions of this Agreement, including, without limitation; and (c) if requested, you have provided accurate and complete registration information, including without limitation, your legal name, address and telephone number.

CheckThisPlaceOut.com is not responsible for renters of property. It is the responsibility of the owner and strongly advised to validate the qualifications of the potential renters. Specify terms and conditions and all charges in writing. Participants in a promotional free trial are not required to provide billing information and have no obligation to purchase a paid listing at the end of the free trial period. Any attempt to register for an additional free trial after the free trial has expired is a violation of these terms and conditions.

By registering on this Site as a vacation rental owner or manager, you agree to the terms and conditions of this disclaimer and Terms of Service Agreement. You agree to provide accurate and current information about yourself as prompted by the registration process and maintain and promptly update your online profile information to keep it accurate and current. CheckThisPlaceOut.com assumes no responsibility for the accuracy of advertisements. Vacation rental owners and managers assert that they have verified the truthfulness of their own advertisement to the best of their knowledge. Regarding photos, owners who specify photos to be used from a web site assert that the photos are their own property and these same owners have the publishing rights to said photos. CheckThisPlaceOut.com has the right to remove any web page and to deny advertising at their discretion. 

You agree that CheckThisPlaceOut.com, at its sole discretion, may remove your listing and terminate your access to this Site and your account at any time and without prior notice for placing inappropriate material, content, photos, links, or any misleading information.

Indemnification

These Terms of Use shall in all respects be governed by, subject to, enforced and construed in accordance with the laws of the State of California including all matters of construction, validity, performance and enforcement. The parties agree that the exclusive jurisdiction and venue of any action between the parties arising out of, or in any way connected with the provisions of these Terms of Use, the subject matter hereof, the parties mutual rights and obligations arising heretofore or hereafter or the performance of any of the terms and conditions hereof by either of the parties hereto shall be the Superior Court of California for the County of Santa Clara and the United States District Court for the Northern District of California, as applicable, and each of the parties hereby submits itself to the exclusive jurisdiction and venue of such courts for purposes of any such action or proceeding.

General
 CheckThisPlaceOut.com shall have the right, at any time and without notice, to add to or modify the terms of this Agreement, simply by posting such amended terms herein. Your access, link to or use of the service after the date such amended terms are delivered to your account with the service shall be deemed to constitute acceptance of such amended terms.
